MCA has issued clarification on the position of Loans Received by private companies from members, directors or their relatives before 01.04.2014, according to this clarification, the said unsecured loans which are received before 01.04.2014 will not be considered as deposits under Companies Act, 2013. 

Any renewal or acceptance of fresh deposits on or after 1st April, 2014 will be governed by the provisions of Companies Act, 2013 and rules made thereunder, hence the same would be covered under definition of deposits under Companies Act, 2013
